I came across a critical review of Nelnet on a Scam Reporting website – DirtyScam.com, titled ‘Nelnet must provide debt validation before taking any action’.
DirtyScam allows anonymous submission of complaints from angry consumers and victims of scams. Since the website is hosted offshore (probably in Russia or India), we take this (negative) review against Nelnet with a pinch of salt.
Here is what the review says –
I received a call for the debt that I owed to some company from Nelnet. The person asked me to make the payment without making any delays or experience the consequences. I asked him to verify my address and other details as well as asked him to share the debt validation proof. However, the guy disconnected the call and did not confirm if he would be helping me with those information. So, I called them back after few days and asked for the details of the debt. To this, they said that they are not liable to present me any document and I should be thinking of how soon to be making the payment instead of arguing. If you guys think that I am not aware of my rights, then you are taking me too lightly.Hence, this is what I want to convey these people:I am the person you are asking to pay the debt to, and you guys are obligated to provide proofs of every details that can validate that the debt was ever taken and was provided to me. This is not a request but my right to information before I pay the debt.I need the information and you are liable to provide me the same under 15 USC 1692g Sec. 809 (b) of the FDCPA. You guys should give me the proof that makes me obliged for paying the debt. And, in the meantime before you provide any validation of the proof, you cannot forward the account to any of the major or other credit bureaus. Or else, you could be charged for fraud under state and federal law. Also, if any negative credit score shows up before you show me the proofs, you might get into trouble under violation of the Fair Debt Collection Practices Act as well as Defamation of Character. Why dont you guys consult your legal team and they would have the same thing to say. After you share the proof, I still get 30 days to investigate the documents legitimacy and come to a conclusion that the debt was reported correctly. Until then, you have no right to spoil my credit score. Also, if you guys are not able to provide me complete proof of this debt in next 30 days, the references of this account must be deleted with the immediate affect from my credit file. It should be completely deleted as if it never existed and you would send me a copy for that confirmation to my email address right away. All what I have said is completely as per the law and if you fail to abide by any of these points, I will certainly take legal action against you and your client. As you know that there have been many scam cases which has made people pay without the real debt, it put me in the right position to ask for such crucial information before I pay you.So, cooperate or you forget about the debt as I will not be liable to pay it.
